Service Description

What is MindBay

MindBay is a mental wellness coach. It provides both short term mental support via its LetsTalk feature, or long-lasting positive change via Growth Coach feature. It does not provide any medical or therapeutic advice, diagnosis, and/or treatment. Instead, through its Growth workshop, it delivers mental wellness exercises that use techniques and methods of Cognitive Behavioural Therapy, in the following way:

Growth Coach helps you reshape your mindset to enhance relationships and boost your career.

 

By identifying and reframing your thought and behaviour patterns, and engaging in practical exercises, you’ll achieve lasting personal and professional growth. It’s a commitment to yourself— challenging but rewarding.

 

Let’s Talk offers a compassionate, non-judgmental space for you to freely express yourself.

Whether you need to let things off your chest or simply blow off some steam, this feature provides a supportive ear without any pressure. It’s a moment of relief, simple yet deeply freeing.

 

Mindfulness offers guided practices and meditations to help you stay present, reduce stress, and enhance emotional well-being through focused relaxation techniques.

User Responsibilities

Accurate Information

To provide you with the best possible service, and for you to gain the full benefits offered by our services, it is essential that you provide us with accurate and up-to-date information. This helps us ensure that we provide support and recommendations that are tailored to your specific needs.

Appropriate Use

You agree to use MindBay for its intended purpose and not for any unlawful or harmful activities. The more you use MindBay for its intended purpose, the better results you will achieve. Remember, MindBay is designed with your best interest in mind, hence it is in your benefit to use it appropriately.

You agree not to: (a) use the App for any unlawful, fraudulent or harmful purpose; (b) transmit material that is defamatory, obscene, or otherwise objectionable; (c) engage in data-mining, scraping or similar data-extraction; (d) introduce viruses or other malicious code; or (e) attempt to gain unauthorised access to the App or related systems. We may suspend or terminate your account for breaching this clause.

MindBay is designed to offer general information and self-help support only; it does NOT provide professional clinical, medical, diagnostic, or treatment advice and must never be relied upon in place of advice from a qualified health-care provider. If at any time you feel that you (i) may harm yourself or others, (ii) are in crisis or (iii) require immediate assistance, you must dial the emergency services (e.g. 999 within the UK) or contact the Samaritans on 116 123 (UK) or your local equivalent without delay.

The App may sign-post or link to crisis resources, but it does not monitor users in real time and does not dispatch emergency services.

You agree that you will not delay seeking professional help because of something you have read or been told by MindBay.

 

If MindBay prompts you to seek professional help you agree that you will do so and that you remain solely responsible for obtaining appropriate clinical care. For any specific concerns in these areas, you should consult a licensed professional.

MindBay is classified as a UK Class I Software as a Medical Device intended only as a self-help adjunct. It does not provide diagnosis or make clinical decisions. Where MindBay is recommended or prescribed by a healthcare professional, that professional:

a. remains solely responsible for assessing the patient’s suitability for the App, including suicide or self-harm risk;

b. must ensure that the patient receives any additional clinical care that may be required; and

c. acknowledges that the App does not lessen or replace their professional duties, standards of care, or insurance obligations.

 

Mindbay Technologies Ltd does not and cannot assume clinical liability arising from decisions made by healthcare professionals. Nothing in these Terms creates a clinician-patient relationship between Mindbay Technologies Ltd and any user.

 

DO NOT use MindBay if you have, or believe you may have, any of the following (this list is non-exhaustive):

  • Severe Mental Health Disorders (e.g.: schizophrenia, bipolar disorder, or severe depression);
  • Acute Mental Health Crises (e.g.: suicidal ideation, or severe anxiety attacks);,
  • Complex Medical Histories involving multiple co-occurring conditions;
  • or where you otherwise require intensive, personalised clinical support.

 

Whilst MindBay can be a useful adjunct, it is not a substitute for professional care, particularly for individuals with limited access to medical services. Always consult a licensed health-care provider to determine the most appropriate form of support for your needs.

Warranties and Liabilities

We rely on the information provided by you to verify your age, gender, occupation, relationship status, education level, and living situation. By using our Services, you represent and warrant that all information you provide is true, accurate and complete. We are not liable for any consequences arising from false or misleading information you provide and we may terminate your access immediately if we discover any such false information.

Except to the extent that the law does not permit such limitation, Mindbay Technologies Ltd (including its directors, employees, consultants and licensors) shall have no liability to you or to any third party for any loss, damage, costs or expenses arising out of, or in connection with, your use of MindBay, including without limitation any self-harm, harm to third parties or deterioration of mental or physical health. Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded, including liability for death or personal injury caused by our negligence or for fraud.

User Indemnity

You agree to indemnify, defend and hold harmless Mindbay Technologies Ltd, its officers, employees and contractors from and against any and all claims, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) any content you upload or transmit through the App; or (c) your unlawful or negligent use of the App.

Intellectual Property Rights

All intellectual property rights in the App, including but not limited to software, algorithms, databases, text, graphics and trademarks (“Mindbay IP”), are owned by or licensed to Mindbay Technologies Ltd.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App in accordance with these Terms.

Except as expressly permitted by law, you must not (a) copy, modify, reproduce, republish or create derivative works from Mindbay IP; (b) reverse-engineer, decompile or disassemble any part of the App; or (c) remove any proprietary notices or branding.

Feedback or suggestions you provide may be used by us without obligation to you, and you assign (or agree to assign) any related rights to Mindbay Technologies Ltd.

User-Generated Content

You retain ownership of any text, responses, journal entries or other content you submit through the App (“User Content”).

You grant Mindbay Technologies Ltd a worldwide, royalty-free, sublicensable licence to store, process, use and, where possible, anonymise and aggregate User Content for the purposes of operating, improving and developing the App.

You confirm that you have all necessary rights to submit User Content and that it does not infringe any third-party rights or contain unlawful material. We reserve the right (but have no obligation) to remove or disable access to any User Content that breaches these Terms.

If the breach is not remediated within this period, the non-breaching party may pursue any remedies available under these Terms or applicable law.

  • Appointment Reminders: Alerts for upcoming sessions or appointments with mental health professionals.
  • Progress Updates: Notifications that provide progress updates and achievements over time.
  • Resource Recommendations: Suggestions for articles, videos, or other resources based on your current mental health needs.
  • Crisis Alerts: Immediate notifications if signs of a mental health crisis are detected, encouraging you to seek professional help.
  • Motivational Messages: Positive affirmations and motivational quotes to encourage and uplift you.
  • Feedback Requests: Periodic prompts asking for feedback on your experience with MindBay to improve service quality for your best interest and needs.
